RECOMMENDATION

Adopt resolution superseding Resolution No. 15-125, which approved the Memorandum of Understanding with the POA effective July 2015 - December 2018 and corresponding salary schedules, to replace the Memorandum of Understanding and corresponding salary schedules in its entirety with the attached revised version.

REPORT NARRATIVE:

The Memorandum of Understanding (MOU) and corresponding salary schedules with the Morgan Hill Police Officers' Association (POA) was approved by Council on June 3, 2015 ("Original MOU").  After a final review of the Original MOU, staff realized that an important condition regarding officers' specialty pay that was highlighted for Council in the staff report and oral report was not included in the actual text of the Original MOU. 

 

The Staff Report for the June 3, 2015 meeting included the following summary of the specialty pay change:

 

"Conversion of 5% Specialty Pay to Flat Rate

Employees hired and working in a specialty assignment such as: School Resource Officer, Investigations (Detective), Task Force Officer, or Traffic Officer prior to June 30, 2015, shall have their five percent (5%) specialty pay converted to a fixed amount, or $250.00 per pay period, whichever is greater effective July 6, 2015. Employees assigned a new specialty assignment after July 1, 2015 would receive a flat rate specialty pay of $250 per pay period."

 

The proposed change to the text of the Original MOU is detailed in italics as follows and highlighted in yellow in the attached revised MOU:

 

5.06                      The Specialized Pay Assignments are Canine (Officer/Corporal), School Resource Officer, Task Force (Officer/Corporal), Detective (Sergeant/Corporal/Officer) and Traffic (Corporal/Officer). The pay received by these Unit Members when they are assigned to a Specialized Pay Assignment ("Specialty Pay") shall be paid according to the following:

 

                     A. Unit Members assigned to a Specialized Pay Assignment as of June 30, 2015 shall                      receive either five percent (5%) of their base salary or a fixed rate of two hundred fifty                      dollars ($250.00) per pay period, whichever is greater, while assigned to a Specialized Pay

                      Assignment.  On July 1, 2015, the five percent (5%) rate will be calculated and converted to                      a flat rate which shall remain fixed during which time the Unit Member remains in a                      Specialized Pay Assignment. 

 

Staff has worked with the POA’s leadership and they are in agreement with this change.Therefore, staff is recommending that Council adopt a resolution superseding the resolution which adopted the Original MOU to replace the Original MOU with the attached revised MOU, incorporating the change discussed above.
