RECOMMENDATION
Adopt resolution approving the following actions:
1. Approving the Second Amendment to Agreement with Biggs Cardosa Associates, Inc. for the Downtown Parking Structure Project in the amount of $53,930 for a total contract amount not to exceed $228,930 to provide third-party building code and structural review and special inspection and testing; and
2. Authorizing the City Manager to execute the Second Amendment to Agreement with Biggs Cardosa Associates, Inc. for the Downtown Parking Structure Project.

REPORT NARRATIVE:
To deliver the Downtown Parking Structure project, a third-party structural plan review and special construction inspection and testing was necessary and integral to the success of the project. On December 17, 2014, the City of Morgan Hill entered into a professional services agreement with Biggs Cardosa Associates, Inc. for third-party structural plan review and special construction inspection and testing during the construction of the Downtown Parking Structure Project in the amount of $128,000.
On November 18, 2015 City Council Meeting, the City entered into a first amendment to the professional contract amending the agreement to increase the amount by $47,000 to $175,000.
Biggs Cardosa's role was to assist with the structural plan review, ensure building code compliance, review structural submittals, and perform special inspections during construction. Their work helped ensure the structural integrity of the parking structure. The project was constructed using a design-build method and it was critical for Biggs Cardosa to stay engaged during the entire process. The two amendments, including the one that is the subject of this report, to the original contract are the result of the ongoing needs of Biggs Cardosa's services during the entire design-build process. Biggs Cardosa was attentive to all structural details and was available at all times for special construction testing. Staff worked closely with Biggs Cardosa to ensure that the design-build contractor had timely and thorough structural services when needed.
Staff recommends approving the Second Amendment for additional special construction inspection and testing of $53,930 for a total not to exceed amount of $228,930.

PRIOR CITY COUNCIL AND COMMISSION ACTIONS:
December 17, 2014 - the City Council awarded a design-build contract for the Downtown Parking Structure Project and approved related agreements, including one with Biggs Cardosa Associates, Inc.
November 18, 2015 - the City Council approved a first amendment to the professional services agreement with Biggs Cardosa Associates, Inc. for the Downtown Parking Structure Project.
FISCAL AND RESOURCE IMPACT:
Upon approval of the second amendment, the final compensation paid to Biggs Cardosa will be $228,930. The approved FY 2015/16 Capital Improvement Program Budget includes the downtown projects and associated implementation costs. Sufficient former RDA bond proceeds exist to support the recommended action. The anticipated expenses for these services were included in the approved ROPS 14-15B and the ROPS 15-16A submittal approval by the Oversight Board and by the State Department of Finance. The additional $53,930 will be paid out of the Downtown Placemaking budget savings from other projects also recommended to be accepted at the September 7, 2016 Council meeting.
