RECOMMENDATION

Adopt resolution:

1.                     Rescinding resolutions 6819 and 7027;

2.                     Approving final map for Barley Place - Tract 10239 for Condominium Purposes;

3.                     Authorizing the City Clerk to sign final map authorizing the abandonment of an unused portion of a public street easement;

4.                     Authorizing the City Manager to execute the Subdivision Improvements Agreement with Barley Place LLC;

5.                     Authorizing the recordation of the final map and Subdivision Improvements Agreement; and

6.                     Authorizing the City Manager to execute a Stormwater Best-Management-Practices (BMP) Operation and Maintenance Agreement pending review and approval by the City Attorney.

REPORT NARRATIVE:

On March 19, 2014, the City Council adopted resolution 6819 approving the Parcel Map for the Granary District project located on the southeast corner of the East Main Avenue and Depot Street intersection (see attached location map). On October 15, 2014, the City Council adopted resolution 7027 approving a revised Parcel Map for the Granary District project to include the abandonment of excess right-of-way along the project frontage on East Main Avenue.

 

The developer never recorded the revised parcel map that was approved on October 15, 2014 and which provided for the abandonment of excess right-of-way. The project has now been reduced in size from 30 to 16 condominium units and renamed Barley Place - Tract No. 10239.

 

The revised project configuration still requires the abandonment of excess right-of-way along East Main Avenue in order for the development to meet city building setback requirements.  As previously stated in the approval of Resolution 7027, the excess right-of-way was conveyed to the City in 1980 and has never been used for roadway purposes. Therefore, the City is in compliance with the requirements for abandoning the excess right-of-way as set forth in Division 9, Part 3, Chapter 4, Section 8330, et seq. of the Streets and Highways Code, specifically Section 8334 that authorizes the City to summarily vacate excess right of way because the right of way has never been used for and is in no way required for streets or highway purposes.  Additionally, the methodology for listing the portion of the public street to be abandoned on the map complies with section 66445(j) of the Subdivision Map Act.

 

The developer, Barley Place LLC, has completed all the conditions specified by the Planning Commission in the approval of the tentative map.  The developer has furnished the City with the necessary documents to complete the processing of the Final Map for Barley Place and has made provisions with a title company to provide the City with the required fees, security, and insurance prior to recordation of the Final Map.

 

Therefore, staff recommends that City Council adopt a resolution that: rescinds Resolutions 6819 and 7027, approves the final map for Barley Place in its revised configuration, authorizes the City Clerk to sign the final map authorizing the abandonment of an unused portion of a public street and authorizes the City Manager to sign a Subdivision Improvements Agreement on behalf of the City and sign a Stormwater BMP Operation and Maintenance Agreement pending review and approval by the City Attorney.

 

COMMUNITY ENGAGEMENT:                     Involve

On February 17, 2016 - City Council Approved Amended Site Review.  Residents within a 300 feet radius were informed of City Council’s intent to approve the amended site review for the project, in which a public hearing was held to give residents an opportunity to voice their concerns or comments of the site review requirements.

PRIOR CITY COUNCIL AND COMMISSION ACTIONS:

City Council Approved Amended Site Review February 17, 2016.

 

FISCAL AND RESOURCE IMPACT:

Development review costs for this project are paid for from development processing fees.

An Environmental Impact Report (EIR) has been prepared and certified for the Downtown Specific Plan.  The project shall be subject to compliance with the mitigation measures of the Downtown Specific Plan EIR on file in the Community Development Department.
