RECOMMENDATION(S)
RECOMMENDATION
Adopt a Resolution approving the following actions:
1.      Accept the Aquatics Center Pool Feeder System in the final amount of $42,985; and
2.      Direct the City Clerk to file the attached Notice of Completion with the County of Santa Clara's Recorder's Office

REPORT NARRATIVE:
The contract for the Aquatics Center Pool Feeder System was awarded to California Waters Development, Inc/California Waters LLC by the City Council at their April 15, 2015 meeting, in the amount of $42,985. The project updated the original Aquatics Center Pool Feeder System.
 
The work was completed on May 20, 2015 in accordance with the plans and specifications for the project. No change orders were issued. The installation of the pool feeder system was completed to the satisfaction of the City's maintenance facilities team.
 
COMMUNITY ENGAGEMENT:      Not Applicable
The timeframe for the installation of the pool feeder system was completed outside the Summer Recreation Swim Season and had no impact on public use of the facility.
 
ALTERNATIVE ACTIONS:
The alternative action is not to accept the project, which would delay the final 5% retention payment of $2,149.25. This is not advisable as the contractor finished the project on time and with budget to staff's satisfaction.
 
PRIOR CITY COUNCIL AND COMMISSION ACTIONS:
On April 15, 2015, the City Council awarded a contract to California Waters Development, Inc./California Waters LLC. In the amount of $42,985 with a 10% contingency of $4,298 for a total authorized amount of $47,283.
 
FISCAL AND RESOURCE IMPACT:
This project was funded by Fund 741 (Future Replacement Fund). There were no change orders during construction and the final contract price is $42,985.  The 10% contingency of $4,298 will be returned to Fund 741.
 
CEQA (California Environmental Quality Act):  
Categorical Exemption
 
The project is categorically exempt from CEQA per Section 15301 (Existing Facilities) as a minor modification to an existing facility.
