RECOMMENDATION(S)

RECOMMENDATION

Adopt resolution approving the following actions:

1.                     Approve Final Map;

2.                     Authorize the City Manager to execute the Subdivision Improvements Agreement with Toll CA XX, LP;

3.                     Authorize the City Manager to execute a Stormwater Best-Management-Practices (BMP) Operation and Maintenance Agreement pending review and approval by the City Attorney; and

4.                     Authorize the recordation of the Final Map and the Subdivision Improvements Agreement.

REPORT NARRATIVE:

San Sebastian Phase 1B - Tract No.10330 is a 33 lot residential subdivision located on Cochrane Road approximately 1500 feet east of Saint Marks Drive (see attached site map), with all the interior subdivision streets being private streets to be maintained by a Home Owners Association (HOA). It is important to note that all street sections are designed to City standards. The developer, Toll CA XX, LP, has completed all the conditions specified by the Planning Commission in the approval of the Tentative Map on February 12, 2013. 

 

The developer has furnished the City with the necessary documents to complete the processing of the Final Map and has made provisions with a Title Company to provide the City with the required fees, security, and insurance prior to recordation of the Final Map. Staff recommends that the City Council authorize the City Manager to sign a Subdivision Improvements Agreement on behalf of the City and sign a Stormwater BMP Operation and Maintenance Agreement pending review and approval by the City Attorney.

 

COMMUNITY ENGAGEMENT:                     Involve

February 12, 2013 - Planning Commission Approved Tentative Map.  Residents within a 300 feet radius were informed of Planning Commission’s intent to approve the tentative map for the project, in which a public hearing was held to give residents an opportunity to voice their concerns or comments of the tentative map requirements.

None.

 

PRIOR CITY COUNCIL AND COMMISSION ACTIONS:

February 12, 2013 - Planning Commission approved 80 lot Tentative Map.

March 27, 2013 - City Council approved a development agreement.

August 30, 2013 - Planning approval of design review of lots 1-79.

September 2, 2015 - Approval of 1 year design review extension 8-30-15 to 8-30-16.

May 26, 2016 -Approval of 1 year design review extension 8-30-16 to 8-30-17.

June 1, 2016  - City Council approval of amended Development Agreement.

July 27, 2016 - City Council Final Map Approval for San Sebastian Phase 1 - Tract No. 10176 (21 lots)

 

FISCAL AND RESOURCE IMPACT:

Development review costs for this project are paid for from development processing fees.

Environment Impact Report was adopted by the City Council on January 23, 2013.
