RECOMMENDATION(S)

RECOMMENDATION

Adopt resolution approving the following actions:

1.                     Accepting as complete the Monterey Road Streetscape Project in the final amount of $2,089,730.40;

2.                     Authorize the Public Works Director to sign the attached Notice of Completion; and

3.                     Direct the City Clerk to file said Notice of Completion with the County Recorder’s Office.

REPORT NARRATIVE:

On May 21, 2014, City Council approved the Downtown Placemaking Investment Strategy for expenditure of RDA Bond proceeds. This included the downtown Monterey Road Streetscape project.

 

The Monterey Road Streetscape Improvement Project spans between Main Avenue and Dunne Avenue.  The scope of work includes:  irrigation upgrades, electrical upgrades, gathering space upgrades, landscaping, park benches, lighting enhancements and pedestrian safety enhancements. 

 

A bid opening was held on June 11, 2015. Two bids were received, Stockbridge General Contracting for $2,151,523.85 and Golden Bay Construction for $2,834,705.  On June 17, 2015, the City Council awarded the contract for the Monterey Road Streetscape Project to Stockbridge General Contracting in the amount of $2,151,523.85.  The City Council also approved a contingency of $322,728.58 for a total authorized project amount of $2,474,252.43.  The project commenced on July 2, 2015 and the project was substantially completed on June 14, 2016.

 

In all, twelve change orders and a settlement agreement were executed for a total amount of $192,923.81.  The settlement agreement between the City and the contractor packaged multiple construction disputes that could not be individually resolved as change orders.

 

The project was completed in accordance with the plans and specifications and staff recommends that the project be accepted. The final contract amount is $2,089,730.40, which includes all change order and settlement amounts owed to Stockbridge.  This is less than the authorized amount of $2,474,252.03 when the project was awarded and, thus, the project balance of $384,522.03 will be returned to the RDA Bond Proceeds Fund (250).

Staff presented the design concepts for Monterey Road Streetscape Improvement Project at the following events:

Coffee with the Mayor on April 11, 2015

Downtown Association on April 9, 2015

PBID meeting on April 22, 2015

City Council on May 20, 2015

 

Staff and contractor kept residents and business owners informed of the project’s progress and completion.  

 

ALTERNATIVE ACTIONS:

Accepting the improvements once the contract is complete in accordance with the contract documents is a required process to complete the construction contract and enables the City to release any retained funds owed to the contractor per the California Public Contract Code Section 7107. 

 

PRIOR CITY COUNCIL AND COMMISSION ACTIONS:

o                     May 21, 2014 - City Council approved the Downtown Placemaking Investment Strategy for expenditure of 2008 Bond proceeds. 

 

o                     June 4, 2014 - City Council approved the retention of Sandis to develop the basis of design related to the Downtown Placemaking Investment Strategy.

 

o                     July 2, 2014 - City Council approved a first amendment to service agreement with Sandis for topographic surveying of the Downtown area.

 

o                     October 1, 2014 - City Council accepted the basis of design for the Monterey Road Streetscape Project.

 

o                     October 15, 2014 - City Council approved Sandis’ second amendment for final design of the Monterey Road Streetscape Improvement.

 

o                     May 20, 2015 - City Council received an update on the Monterey Road Streetscape project.

 

o                     June 17, 2015 - City Council awarded contract to Stockbridge General Contracting for the Monterey Road Streetscape Project.

 

FISCAL AND RESOURCE IMPACT:

The project was budgeted in the FY14/15 and FY15/16 Budgets in the Downtown Improvement Projects and any associated implementation costs.  The source of funding is from former RDA bond proceeds (Fund 250).  These expenses were included in ROPS 14-5B and ROPS 15-16A and were approved by the Oversight Board and the State Department of Finance.

 

The total construction authorization for this project was $2,474,252.43, which includes a 10% contingency of $322,728.58.  The final contract amount, including all change orders, settlement amounts and final quantities is $2,089,730.40.  The balance amount of $384,522.03 ($2,474,252.43 - $2,089,730.40) will be returned to Fund 250 (and expended on other downtown placemaking projects).
