RECOMMENDATION(S)

RECOMMENDATION

Adopt resolution approving the following actions:

1.                     Accept as complete the El Toro Fire Station Kitchen Remodel Project in the final amount of $53,539;

2.                     Authorize the Public Works Director to sign the attached Notice of Completion; and

3.                     Direct the City Clerk to file said Notice of Completion with the County Recorder’s Office.

REPORT NARRATIVE:

The El Toro Fire Station is one of two fire stations owned and maintained by the City of Morgan Hill.  The El Toro Fire Station being built in 1978, still contained the original kitchen.  The cabinets and counters were severely worn and in need of replacement. On any given day, the fire station houses four to seven firefighters and administrative personnel 24 hours a day, seven days a week.  For many of our firefighting teammates, the fire station is their home away from home.  The kitchen at the El Toro Fire Station is used extensively on an around-the-clock basis.  Therefore, the kitchen upgrade was important for maintaining the quality of life for our firefighters, and for providing clean and safe living conditions.  The scope of work included: the removal of the existing kitchen components, the installation of new cabinets and counter tops, a new sink and faucet, new backsplash and additional electrical outlets.

 

The project was originally bid on June 2, 2015 and two bids were received. The project was awarded to the low bidder, but the contractor failed to provide the required insurance and bonds to execute the contract. On September 2, 2015, City Council rescinded the award and directed staff to rebid the project.

 

Per Council's direction, staff rebid the project and the lowest responsible bidder was determined to be Sigura Construction.  On February 3, 2016, City Council awarded the contract to Sigura Construction for $50,789 with a contingency of $5,079.  During the demolition process, Sigura Construction found water damage on the wall behind the sink. Thus, a change order was issued for $2,750 to remove and replace the drywall, insulation, and plywood sheer wall behind the sink.  The Building Department inspected the repair as well as the kitchen remodel work and all the work met the applicable building code requirements. Thus, the final contract amount is $53,539 ($50,789+$2,750).

 

Staff therefore recommends acceptance of the project, as the work is complete and the kitchen is fully operational.

ALTERNATIVE ACTIONS:

Accepting the improvements once the contract is complete in accordance with the contract documents is a required process to complete the construction contract and enables the City to release any retained funds owed to the contractor per the California Public Contract Code Section 7107.

 

PRIOR CITY COUNCIL AND COMMISSION ACTIONS:

o                     June 17, 2015, City Council Awarded a contract to Santa Clara Valley Construction for the El Toro Fire Station Kitchen Remodel project for $21,633.

 

o                     September 2, 2015, City Council rescinded Resolution 15-146 awarding the contract to Santa Clara Valley Construction and directed staff to rebid the project.

 

o                     February 3, 2016, City Council awarded the El Toro Fire Station Kitchen Remodel Project to Sigura Construction in the amount of $50,789 with a contingency of $5,079.

 

FISCAL AND RESOURCE IMPACT:

The total authorization for this project was $55,868, which included a 10% contingency of $5,079.  The final contract amount is $53,539 and was funded by Fire Operations in the General Fund.  No additional budget appropriation is required.

Categorical Exemption

 

The activities described in this Staff Report are categorically exempt under CEQA, specifically pursuant to Section 15301 of the CEQA Guidelines (Existing Facilities), as the subject work involves the repair, maintenance, or minor alteration of existing City facilities involving negligible or no expansion of use of those facilities.
